1. Introduction1. 简介
These Terms of Service (the "Terms") form a binding agreement between you ("you", "your") and Curio Design ("Curio", "we", "our", or "us") and govern your access to and use of the website at designbycurio.com and any related applications, application programming interfaces ("API"), command-line tools, and integrations (collectively, the "Service"). 本服务条款(以下简称「本条款」)构成您(以下简称「您」)与 Curio Design(以下简称「Curio」「我们」)之间具有法律约束力的协议,规定您访问和使用 designbycurio.com 网站以及相关应用程序、应用编程接口(API)、命令行工具与集成(以下统称「本服务」)的方式。

- A bundle published by Curio containing design tokens, sample renderings, documentation, and machine-readable specifications for a single design style.指 Curio 发布的、包含某一设计风格的设计 token、样例渲染、说明文档与机器可读规范的资料集合。
- "Credit"「配额」
- A unit of consumption charged against your plan when you perform a metered action (see Section 5.2).指您执行计数操作(详见第 5.2 条)时从您当前套餐中扣除的使用单位。
- "Subscription"「订阅」
- A recurring fee arrangement between you and Curio that grants access to a specified Plan during a Billing Period.指您与 Curio 之间约定的周期性付费安排,授予您在某一计费周期内使用指定套餐的权利。

3. Account & access3. 账户与登录
3.1 Eligibility3.1 准入条件
You must be at least 13 years of age, or the minimum digital-consent age in your jurisdiction (whichever is higher), to register an Account. By using the Service you represent that you meet this requirement. 您必须年满 13 周岁,或达到您所在司法管辖区规定的数字同意最低年龄(两者取其高者),方可注册账户。使用本服务即视为您声明已满足上述年龄要求。

You may register and sign in via email magic link, GitHub, or Google. Each email address may be bound to one and only one authentication method. Attempts to access an Account through a method other than the one originally used will be rejected. You are responsible for maintaining the confidentiality of, and access to, the email address or third-party authentication account associated with your Account. The Service is a library of Design Packages curated and produced by Curio. Design Packages are designed to be consumed by AI agents and human users to apply visual styles to slides, websites, products, and other creative output. 本服务是由 Curio 策划与制作的设计包资料库。设计包旨在供 AI agent 与人类用户使用,以便将视觉风格应用于演示、网站、产品及其他创意产出。
We may add, modify, or retire Design Packages from time to time. Where retirement would materially affect paying Subscribers, we will provide at least 30 days' notice before the affected Package becomes unavailable to existing Subscribers. 我们可不时新增、修改或下架设计包。如下架将对付费订阅者产生实质影响,我们会在受影响的设计包对现有订阅者不可用前,提前至少 30 日发出通知。

The Service is offered under three plan tiers: 本服务提供三档套餐:
- Free — gallery browsing and access to designated free Design Packages, subject to a lifetime allowance of 5 Credits.Free(免费):可浏览风格库及使用指定的免费设计包,配额上限为终身累计 5 次。
- Pro — access to the full library, subject to a rolling 7-day allowance of 25 Credits.Pro(专业):可使用全部设计包,配额上限为滚动 7 日内 25 次。
- Max — full library access with a rolling 7-day allowance of 200 Credits, plus the right to submit design feedback through the dedicated Max feedback channel.Max(高用量):可使用全部设计包,配额上限为滚动 7 日内 200 次,并可通过 Max 专属反馈通道向我们提交设计意见。
For paid tiers, the 7-day allowance is calculated on a sliding basis: each consumed Credit becomes available again 7 days after consumption, rather than resetting on a fixed calendar day. 付费套餐的 7 日配额按滚动方式计算:每次消耗的配额将在该次消耗 7 日后释放,并非按固定历日统一重置。
5.2 Metered actions5.2 计数操作
The following actions consume one (1) Credit per occurrence: (a) generating a share link for a Design Package, (b) downloading a token bundle, and (c) invoking a Design Package through the API or command-line tools. 6. Fees & billing6. 费用与计费
6.1 Payment processor6.1 付款处理方
Paid Subscriptions are billed through PayPal. By subscribing, you authorize PayPal to charge your selected funding source for the applicable Subscription fees on each renewal date. Your use of PayPal is also governed by PayPal's own user agreement and buyer/seller policies, available at paypal.com. 付费订阅通过 PayPal 进行计费。您订阅时即授权 PayPal 在每个续费日按对应的订阅费用从您所选的付款来源中扣款。您使用 PayPal 还受 PayPal 自身的用户协议与买家/卖家政策约束,详见 paypal.com。
6.2 Upgrades6.2 升级
If you upgrade your Plan mid-cycle (for example, from Pro to Max, or from a monthly to an annual cycle), the prior Plan is cancelled at PayPal and will not renew. A fresh Subscription at the new Plan is charged in full at the start of a new Billing Period. No refund is issued for the unused portion of the prior Plan; your access on the prior Plan continues alongside the new Plan through the original Billing Period end. 如您在计费周期内升级套餐(例如由 Pro 升级至 Max,或由月付切换至年付),原套餐将在 PayPal 取消并不再续费,新套餐将于新的计费周期开始时按全额计费。原套餐未使用部分不予退款;在原计费周期结束之前,原套餐的访问权限将与新套餐并存。
Plan changes are monotonic: you may move to a Plan with higher usage volume or a longer billing cycle, but you may not downgrade to a lower tier or a shorter billing cycle within an active Subscription. To move to a lower tier or to Free, cancel the Subscription and allow the Billing Period to expire, then re-subscribe at the desired tier. 套餐变更须为单调升级:您可切换至更高额度或更长计费周期的套餐,但不可在订阅有效期内降级至更低档位或更短计费周期。如需切换至更低档位或 Free,请先取消订阅并待当前计费周期到期,再按所需档位重新订阅。
6.3 Cancellation6.3 取消
You may cancel your Subscription at any time from the Billing page. Cancellation takes effect at the end of the then-current Billing Period; no refund is issued for the remaining portion of that period. Upon expiry your Account reverts to the Free tier. 您可随时在「账单」页面取消订阅。取消将在当前计费周期结束时生效;剩余计费周期不予退款。订阅到期后账户自动恢复为 Free 套餐。
6.4 Failed renewal6.4 续费失败
If a renewal payment fails, your Subscription enters a short retry window during which PayPal attempts to charge your funding source again according to its standard retry schedule. Your Account continues to have paid-tier access throughout the retry window. If all retries fail, your Subscription terminates and your Account reverts to the Free tier. You may not downgrade an active paid Subscription to the Free tier, to a lower tier, or to a shorter billing cycle within the current Billing Period. To move to Free or to a lower tier, cancel the Subscription and allow the Billing Period to expire, then re-subscribe at the desired tier if applicable. 计费周期内,不允许将处于有效期的付费订阅降至 Free 套餐、更低档位,或更短的计费周期。如需切换至 Free 或更低档位,请先取消订阅并待当前计费周期自然到期,如需重新订阅再按所需档位订阅。

Subscription fees are exclusive of taxes. You are responsible for any value-added tax, goods-and-services tax, sales tax, or similar charges payable in your jurisdiction in connection with your Subscription. 订阅费用不包含税费。与您订阅相关的、在您所在司法管辖区应缴的增值税、商品与服务税、销售税或类似税费,由您自行承担。
6.7 Right of withdrawal (EU/UK consumers)6.7 撤回权(欧盟/英国消费者)
If you are a consumer resident in the European Union or the United Kingdom, you have a statutory right to withdraw from a paid Subscription within fourteen (14) days of purchase without giving a reason. To exercise this right, send a written request to [email protected] within the 14-day period. 如您是欧盟或英国的消费者,自购买付费订阅之日起十四(14)日内,您依法享有无需理由的撤回权。如需行使该权利,请在 14 日期限内通过 [email protected] 提交书面请求。
If you have requested that we begin providing the Service immediately (for example, by consuming any Credit during the 14-day window), you acknowledge that the Service constitutes digital content supplied immediately at your express request, that you lose your right of withdrawal once delivery begins, and that any Credits you have consumed before withdrawal are non-refundable. 7. Acceptable use7. 使用规范
You agree not to, and not to permit any third party to: 您同意不进行下列行为,亦不允许任何第三方从事下列行为:
- scrape, copy, or systematically retrieve content from the Service in a manner designed to circumvent the Credit system;以规避配额机制为目的,抓取、复制或系统性地获取本服务的内容;
- resell, sublicense, or redistribute any Design Package as a standalone product or as a substantial component of a competing offering;将任何设计包作为独立产品或竞品的实质性组成部分进行转售、再许可或再分发;
- attempt to bypass paywalls, falsify Subscription state, or share Subscription entitlements between Accounts;试图绕过付费墙、伪造订阅状态,或在多个账户间共享订阅权益;
- reverse-engineer, decompile, or otherwise attempt to derive the source code or training data of the Service except to the extent expressly permitted by law;除法律明确允许的范围外,反向工程、反编译或以其他方式试图获取本服务的源代码或训练数据;
- use the Service to train an artificial intelligence model intended to replicate or substitute for the Service;使用本服务训练旨在复制或替代本服务的人工智能模型;

The Service, all Design Packages, and all related text, code, documentation, and visual material (the "Curio Content") are owned by Curio or its licensors and are protected by copyright, trademark, and other applicable laws. Subject to your compliance with these Terms and payment of applicable Subscription fees, Curio grants you a worldwide, non-exclusive, non-sublicensable, non-transferable license to apply Design Packages you legitimately access to your own slides, websites, products, and other creative work, including for commercial purposes. Certain Design Packages reference well-known design movements, historical periods, and named brands (for example, "Memphis 1981", "Stripe 2024", or "Bauhaus Weimar") for educational and descriptive purposes. Such references identify the source of inspiration only. Curio is not affiliated with, sponsored by, or endorsed by any of the brands, designers, or estates referenced. If you submit suggestions, requests, or other feedback through the Service (including via the Max feedback channel), you grant Curio a perpetual, irrevocable, royalty-free, worldwide license to use, reproduce, modify, and incorporate such feedback into the Service. To the maximum extent permitted by applicable law, the Service and Curio Content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, secure, or error-free. Curio does not warrant that any Design Package will be suitable for your specific project or that AI-generated output incorporating Curio Content will meet your expectations. 在适用法律允许的最大范围内,本服务与 Curio 内容按「现状」与「可获取即用」的方式提供,不附带任何明示、默示或法定的保证,包括但不限于关于适销性、特定用途适用性、不侵权的默示保证,或服务不中断、安全、无错误的保证。Curio 不保证任一设计包将适合您的具体项目,亦不保证使用 Curio 内容生成的 AI 产出将符合您的期望。
10. Limitation of liability10. 责任限制
To the maximum extent permitted by applicable law, Curio shall not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with these Terms or your use of the Service, whether based on contract, tort, statute, or any other legal theory, and whether or not Curio was advised of the possibility of such damages. 在适用法律允许的最大范围内,对于因本条款或您使用本服务而产生或与之相关的任何间接、附带、特殊、连带、警示性或惩罚性损害,以及任何利润、收入、数据、商誉或商业机会的损失,无论基于合同、侵权、法定或其他任何法律理论,亦无论 Curio 是否已被告知此类损害的可能性,Curio 均不承担责任。
Curio's aggregate liability arising out of or relating to these Terms or the Service, regardless of cause of action, shall not exceed the greater of (a) the amount you paid to Curio for the Service during the twelve (12) months preceding the event giving rise to the claim, or (b) fifty United States dollars (USD 50). 无论起因为何,Curio 因本条款或本服务而产生或与之相关的累计责任上限为:(a) 您在引发索赔的事件发生前十二(12)个月内向 Curio 支付的金额;或 (b) 五十美元(USD 50)—— 取两者较高者。

You may stop using the Service at any time. To delete your Account and the personal data associated with it, send a request from your registered email address to [email protected]. We process deletion requests manually within thirty (30) days. We may suspend or terminate your Account, with or without notice, if you breach these Terms, if your Subscription remains unpaid, or if continued provision of the Service would expose Curio or other users to material risk. Upon termination, your right to access the Service ceases. We may update these Terms from time to time. For material changes, we will update the "Last updated" date at the top of this document and notify active Subscribers by email at least seven (7) days before the change takes effect. These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Curio is established, without regard to its conflict-of-laws rules. To the extent permitted by law, you agree that any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts located in that jurisdiction. Upon receipt of a valid notice we will, where appropriate, remove or disable access to the material identified, notify the affected user (if any), and consider any counter-notice submitted under the same procedure. We will terminate the Accounts of repeat infringers in appropriate circumstances.
